Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Spyros Galanis (“we,” “us,” or “our”), concerning your access to and use of the Sybil AI Extension (the "Extension").

By installing, accessing, or using the Extension, you acknowledge that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the Extension and you must discontinue use immediately.

Your use of the Extension is also governed by our Privacy Policy, which is incorporated herein by reference.

2. Description of the Service

The Extension provides users with a tool to simulate and log an internet Browse session using an AI agent. The agent's behaviour is guided by a user-defined "persona." The primary purpose of the Extension is to allow for research, analysis, and understanding of different user journeys and digital footprints. The Extension programmatically controls a browser tab to navigate the web and generates a detailed report of the session's activities.

3. User Accounts and Subscriptions

  1. Accounts: To differentiate between user tiers, the Extension uses the chrome.identity API to associate your browser profile with a unique user ID.
  2. Payments and Subscriptions: We offer free and paid ("Premium") subscription plans. All payments are processed through our third-party payment processor, Stripe. By purchasing a subscription, you agree to be bound by Stripe's own terms and conditions.
  3. Usage Limits: Free accounts are subject to usage limits, including a maximum number of reports, personas, and session duration, as detailed within the Extension. Premium accounts have higher or unlimited access.
  4. Cancellations: You may cancel your subscription at any time through the customer billing portal provided within the Extension. Your cancellation will take effect at the end of the current paid term.

4. User Responsibilities and Conduct

As a user of the Extension, you agree to the following:

  1. Lawful Use: You will use the Extension only for lawful purposes and in accordance with these Terms and any applicable laws.
  2. API Keys and Costs: When using third-party Large Language Models (LLMs) such as OpenAI, Google Gemini, Anthropic Claude, etc., you are required to provide your own API key. You are solely responsible for all costs and charges incurred on your third-party LLM accounts as a result of using the Extension. We are not responsible for monitoring or managing your API usage or costs.
  3. Responsibility for AI Actions: You are solely responsible for the personas you create and the actions the AI agent takes on your behalf. You agree not to use the Extension to engage in any activity that is illegal, malicious, or violates the terms of service of any website the agent visits. This includes, but is not limited to, unauthorized data scraping, attempting to breach security measures, or generating harmful content.
  4. Prohibited Activities: You shall not use the Extension for any high-risk activities where failure could lead to personal injury, death, or severe property or environmental damage. You will not use the Extension to impersonate any person or entity falsely.

5. Intellectual Property Rights

  1. Our IP: We own all rights, title, and interest in and to the Extension, including all source code, designs, graphics, and branding. These are protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Extension in accordance with these Terms.
  2. Your IP: You retain all rights to the content you create, such as your custom personas. You also own the output of the service, which includes the generated session reports. You are responsible for how you use these reports.

6. Third-Party Services

The Extension relies on several third-party services to function. Your use of these services is subject to their respective terms and policies.

We are not responsible or liable for the performance, content, or policies of any third-party service.

7. Disclaimer of Warranties

THE EXTENSION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. YOU AGREE THAT YOUR USE OF THE EXTENSION IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE EXTENSION AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF THE EXTENSION'S FUNCTIONALITY OR THE OUTPUT GENERATED BY THE AI AGENT. THE BEHAVIOUR OF AI CAN BE UNPREDICTABLE, AND WE DO NOT GUARANTEE THAT THE SIMULATION WILL MEET YOUR EXPECTATIONS OR BE FREE FROM ERRORS.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE EXTENSION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THIS INCLUDES, BUT IS NOT LIMITED TO, ANY DAMAGES OR FINANCIAL LOSSES INCURRED FROM API COSTS BILLED TO YOU BY THIRD-PARTY LLM PROVIDERS. OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE THREE (3) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.

9. Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your use of the Extension; (2) your breach of these Terms; or (3) your violation of the rights of a third party, including but not limited to another website's terms of service.

10. Termination

We reserve the right, in our sole discretion, to suspend or terminate your account and access to the Extension without notice or liability, for any reason, including without limitation if you breach these Terms.

You may terminate these Terms at any time by uninstalling the Extension and ceasing all use. Uninstalling the Extension will result in the deletion of all locally stored data associated with it.

11. Governing Law and Dispute Resolution

These Terms and your use of the Extension are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in London, England, and the parties irrevocably consent to the personal jurisdiction and venue therein.

12. Changes to Terms

We may modify these Terms at any time. We will post the revised Terms and update the "Effective Date" at the top of this document. Your continued use of the Extension after any such changes constitutes your acceptance of the new Terms.
